Doe v. Ohio Department of Education Notice

  • The State of Ohio, the Governor, the Ohio Department of Education, and other state-level defendants to a class action lawsuit have reached a proposed settlement and have requested our District's assistance in informing students and parents of the proposed settlement. Our District is not a defendant in this lawsuit and is not accused of any wrongdoing in this lawsuit. We are sharing this information as a courtesy to the Ohio Department of Education and our community.

     

    The Notice of Proposed Class Action Settlement states that it affects “[s]tudents with disabilities in Ohio’ public schools, including those who have or could have an individualized education program (IEP) or a Section 504 plan and their parents.” The court has scheduled a Final Fairness Hearing for February 11, 2020, to determine whether the class action settlement is fair, reasonable, and in the best interest of the class members. If you wish to submit comments to the settlement agreement or appear at the hearing, the court has established certain requirements that class members must follow. If you wish to appear, and be heard, at the hearing, you must notify the court in advance. A link to the settlement can be found here.
